Restraining Order
A court order temporarily prohibiting specified conduct, often used in disputes pending hearing.
A restraining order is a court order temporarily prohibiting specified conduct, often issued on short notice while a dispute is pending. Civil restraining orders address harassment, business interference, and threats; domestic violence and workplace orders have their own statutory schemes.
A temporary restraining order (TRO) can last up to 15 days and is issued on a one-sided showing of irreparable harm; it is followed by a hearing on a preliminary injunction with full briefing and evidence.
California courts grant civil restraining orders for trade-secret misuse, trademark infringement at retail, contract interference, and threats of asset dissipation. We seek and oppose restraining orders in California state and federal courts.
