Mediation is a confidential dispute-resolution process where a neutral third party, the mediator, facilitates discussion between the parties to help them reach their own settlement. The mediator does not decide the case.
It is faster, cheaper, and more flexible than litigation, and the conversation is privileged, what is said in mediation cannot be used as evidence later under California Evidence Code §1119. Most California courts and many contracts require parties to attempt mediation before trial.
Mediation works well for commercial disputes, partnership separations, breach-of-contract matters, and IP licensing conflicts. We prepare clients for mediation, present persuasive position statements, and negotiate enforceable settlement agreements that close the matter cleanly.
